Comelec suspends Erwin Tulfo Proclamation in ACT-CIS

The Commission on Elections (COMELEC) has suspended the proclamation of Mr. Erwin P. Tulfo, nominee next-in-line of ACT-CIS Party-List Group, following the filing of a Petition for Disqualification against him on February 28, 2023.

Atty. Moises S. Tolentino, Jr. filed the petition, which was taken cognizance by the Commission under Sections 1 to 5 of Rule 5 of COMELEC Resolution No. 9366.

The petition cites allegations of "question of citizenship" and "conviction by final judgment of a crime involving moral turpitude" against Mr. Tulfo. As a result, the Commission has suspended his proclamation, despite the fact that ACT-CIS Party-List Group received the winning number of votes in the election.

The suspension is in accordance with Section 8 of Rule 5 of Resolution No. 9366, which allows the suspension of the proclamation of a nominee if the evidence in the Petition for Disqualification is strong and remains unresolved.

The case is scheduled to be raffled to a Division for Hearing on March 6, 2023.

The suspension of Mr. Tulfo's proclamation has raised questions about the impact it may have on ACT-CIS Party-List Group's representation in the House of Representatives.
