PBBM Issues EO For Coordination In Implementation Of Mandanas Ruling

President Ferdinand R. Marcos Jr. announced on Friday his plans to issue a new executive order aimed at enhancing the coordination and partnership between the local and national government in implementing the Mandanas ruling. Speaking at the 4th General Assembly of the League of Provinces of the Philippines (LPP) in Pampanga, Marcos emphasized the significance of a harmonized relationship between the two levels of government.
Addressing the assembly, Marcos stated, "You are not working in a vacuum. We are watching, we are asking, we are consulting with you. And in that way, we will come out with a good Executive Order at the end of the year for a good implementation of the very important Supreme Court decision now we call the Mandanas-Garcia ruling." The Mandanas ruling refers to a landmark Supreme Court decision regarding the administrative autonomy of local government units (LGUs).
Marcos disclosed that he had postponed the implementation of Executive Order No. 138, which was initially issued to support the efficient implementation of the Supreme Court ruling and to strengthen the autonomy and empowerment of LGUs. The suspended executive order also called for the full devolution of certain functions from the national executive branch to the LGUs.
Explaining the rationale behind the postponement, Marcos stated, "We gave ourselves until the end of the year 2023 – until the end of this year. And I will sign another executive order putting into place all – and defining very clearly which of the services, which of the functions belong to the local government and which belong to the national government." He further emphasized that this move would provide local officials with the opportunity to take independent action.
While stressing that some functions would be devolved, Marcos highlighted that the devolution would be accompanied by resources, funding, and training. He assured local officials that there would be an ongoing exchange of ideas to address practical considerations and ensure the effective delivery of services mandated by the Local Government Code.
Marcos expressed confidence in the ability of local government officials to perform well, emphasizing their understanding of the real situation in their respective jurisdictions. Drawing from his own experience as a former Vice Governor, Governor, and 2nd District Representative of Ilocos Norte, he underscored the value of local government talent.
With President Ferdinand R. Marcos Jr.'s commitment to strengthening the partnership between the local and national government and his plans to issue a new executive order, it is expected that the implementation of the Mandanas ruling will be further supported, empowering LGUs and promoting administrative autonomy at the local level.
