SC Orders Comelec To Proclaim Robert Uy Jr As Zamboanga Del Norte First District Representative
The Supreme Court's recent En Banc deliberation on August 8, 2023, has directed the Commission on Elections (COMELEC) to declare Roberto 'Pinpin' T. Uy, Jr. as the official winner of the 2022 elections for the Zamboanga del Norte First District Representative position. This decision comes after a series of legal disputes surrounding the election results and candidate claims.

In a significant legal ruling authored by Justice Mario V. Lopez, the Court granted the consolidated petitions in the cases of Roberto 'Pinpin' T. Uy, Jr. v. COMELEC, et al. (G.R. No. 260650) and Frederico P. Jalosjos v. Romeo M. Jalosjos, Jr. and COMELEC (G.R. No. 260952). The Court overturned the COMELEC En Banc's previous Order and Resolution, citing grave abuse of discretion and irregularities in their execution.

The election dispute stemmed from a contested candidate, Frederico "Kuya Jan" Jalosjos (F. Jalosjos), being declared a nuisance candidate by the COMELEC. This decision was challenged, leading to a complex legal battle. The Supreme Court's ruling emphasizes that the candidate with the highest number of votes should be proclaimed without unnecessary delay, highlighting the mechanical role of the board of canvassers in this process.

The Court's decision invalidated the suspension of Uy's proclamation by the COMELEC, which was deemed inappropriate since Uy was not a party in the proceeding related to the declaration of F. Jalosjos as a nuisance candidate. The Court also critiqued irregularities in the suspension order process, including incomplete signatures and unauthorized interventions.

Furthermore, the Court's ruling affirms that the House of Representatives Electoral Tribunal (HRET) lacks jurisdiction over the case, as essential requisites such as a valid proclamation, proper oath, and assumption of office were not met by one of the contested candidates.
