The Supreme Court has mandated the Department of Transportation (DOTr) and the Land Transportation Franchising and Regulatory Board (LTFRB) to provide comments within a non-extendible period of 10 days on a Petition for Certiorari and Prohibition.
The petition, filed by public utility jeepney operators and transport groups, including PISTON, challenges various DOTr and LTFRB issuances related to public road transportation services and franchise issuance.
The Court has directed the respondents, DOTr and LTFRB, to personally file their comments and serve them on the petitioners. The Process Serving Unit of the Office of the Clerk of Court En Banc is tasked with personally serving the Court's Order on all parties involved.
The petitioners, led by PISTON Chairperson Modesto T. Floranda, submitted their petition on December 19, 2023.
They seek to restrain the enforcement and declare null and void several DOTr and LTFRB issuances, including Department Order No. 2017-011 and various Memorandum Circulars related to the consolidation of franchise holders.
