Senate Ratifies Agreements Safeguarding Rights Of OFWs

The Senate on Wednesday, December 13, 2023, concurred in the ratification of two resolutions aimed at upholding and protecting the rights and welfare of Filipino migrant workers in Brunei Darussalam and the Republic of Korea.
During the plenary session, the Senate unanimously approved Senate Resolution No. (SRN) 790 and SRN 878, both integral to ensuring the well-being and rights of Filipino expatriates in Brunei Darussalam and the Republic of Korea. The resolutions were sponsored by Senator Imee R. Marcos, the chairperson of the Committee on Foreign Relations.
SRN 790 concurs in the ratification of the agreement between the Philippines and Brunei Darussalam for the avoidance of double taxation and the prevention of fiscal evasion concerning taxes on income. This resolution is set to apply to residents of both contracting states, with implications on various taxes imposed on behalf of a contracting state.
The agreement aims to strengthen the Philippines' commitment to the Association of Southeast Asian Nations (ASEAN) Forum on Taxation, mitigate adverse effects of double taxation, enhance bilateral trade relations, generate employment opportunities for Filipinos in Brunei Darussalam, attract investments, and foster the transfer of technology and skills.
Meanwhile, SRN 878 signifies the Senate's approval of the agreement on social security between the Philippines and the Republic of Korea. This resolution is designed to promote mutual cooperation in the field of social security, ensuring equal treatment for covered individuals, including their dependents and survivors. The agreement, applicable to the National Pension Act of Korea and key Philippine legislations, focuses on Republic Act No. 11199 (Social Security Act of 2018), Republic Act No. 8291 (Government Service Insurance Act of 1997), and Republic Act No. 7699 (Portability Law). It provides for the export of benefits, totalization of insurance periods, and mutual administrative assistance, emphasizing the continued receipt of social security benefits for covered individuals, regardless of their country of residence.
