The Supreme Court (SC) ordered the suspension of former Press Secretary Rose Beatrix “Trixie” Cruz-Angeles for six months following a complaint against Angeles and Atty Ahmed Paglinawan for using abusive, offensive, and improper language in a pleading submitted to the Metropolitan Trial Court (MeTC) of Quezon City. The case was originally filed by Attorney Roderick Manzano.
This decision was connected to the March 27, 2023 resolution issued by the Third Division of the SC affirming the findings of the Integrated Bar of the Philippines - Commission on Bar Discipline (IBP-CBD) regarding the liability the two lawyers for violation of Rule 8.01, Canon 8 of the Code of Professional Responsibility. The pleading was related to an unlawful detainer case, Civil Case No. 16-01432-SC(S).
After a careful examination of the arguments presented, the Court found that the IBP-CBD did not make any errors in its determination of respondents' arguments regarding Atty. Manzano's legal standing and personal knowledge were without merit. The Court, therefore, upheld the IBP-CBD's findings.
With regard to the penalties to be imposed, the Court agreed with the recommendations of the IBP-CBD and the IBP Board of Governors. It was noted that Atty. Cruz-Angeles did not file or sign the Motion for Reconsideration and had previously been suspended from the practice of law. As a result, the Court ordered her suspension from the practice of law for a period of six months. On the other hand, considering that this was Atty. Paglinawan's first infraction, the Court found the penalty of reprimand to be reasonable in his case.
The Court concluded the resolution by warning both respondents that any repetition of the same or similar act in the future would be dealt with more severely. A copy of the resolution will be attached to their personal records in the Office of the Bar Confidant.
Angeles meanwhile in a public statement, clarified that she was not the author of the said pleading and asserted that it was their defense to exhaust all available remedies to present their case before the Supreme Court fully.
Expressing gratitude to her supporters and well-wishers, Angeles acknowledged the outpouring of positive messages and support she has received. She emphasized that these gestures have deeply touched her and would provide assistance during these challenging times. However, she urged everyone to refrain from disrespecting the court and advised against using offensive language towards the justices of the Supreme Court.
She reiterated their commitment to pursuing all legal remedies available while emphasizing the importance of respecting the rule of law and the court's processes.
