Nutri-Asia Fights Back Against Dali

Nutri-Asia, Inc., a beloved name in Filipino households for its popular UFC and Datu Puti products, has taken a strong stand against trademark infringement.

Represented by the law firm Cruz Marcelo and Tenefrancia, Nutri-Asia filed a complaint with the Bureau of Legal Affairs of the Intellectual Property Office. Their target? Hard Discount Philippines, the company behind DALI Everyday Grocer.

The complaint centers on DALI's sale of Kulina catsup and chili sauce, as well as Rajah Puro vinegar and soy sauce. According to Nutri-Asia, the packaging of these products is confusingly similar to their UFC and Datu Puti brands, potentially misleading consumers.

During the injunction hearings, Nutri-Asia's legal team convincingly demonstrated the company's intellectual property rights over their iconic brands. As a result, the Bureau of Legal Affairs issued an injunction in February 2024, protecting the reputation and goodwill of UFC and Datu Puti. The injunction orders DALI to halt the manufacturing and sale of the disputed Rajah Puro and Kulina products due to their resemblance to Nutri-Asia's offerings.

Following the injunction, DALI quickly complied by removing the contested items from their stores. Nutri-Asia has emphasized its dedication to safeguarding its intellectual property and has vowed to prosecute any violators.

DALI, which opened its first store in February 2020 in Santa Rosa, Laguna, now faces the challenge of reformulating or repackaging its products to steer clear of any legal issues.

This case underscores the importance of protecting intellectual property rights and the lengths companies will go to preserve their brand integrity. Nutri-Asia's victory not only safeguards its products but also reinforces its commitment to maintaining the trust and loyalty of Filipino consumers.
