SC denies petition for Duterte’s health records

The Supreme Court (SC) in a 13-2 vote has denied the petition filed by Atty. Dino De Leon to make President Rodrigo Duterte reveal his state of health. 

SC Associate Justices Marvic Leonen and Alfredo Benjamin Caguioa were the dissenters.

De Leon said he will file a motion for reconsideration after securing a copy of the SC’s resolution.

“For as long as there are people with uncompromising integrity who are willing to fight for this nation, there is hope,” he said on Facebook.

De Leon filed an urgent petition for mandamus on April 13 asking the SC to intervene after his request for Duterte’s health records from Malacañang based on the Freedom of Information (FOI) law was denied.

He said Duterte’s incoherent, unresponsive, and unintelligible rambling in previous interviews was what prompted him to file the petition. 

Citing Section 12 of Article VII of the 1987 Constitution, De Leon said the public deserves to know the President's health condition.
